What the surveyor found

Based on record review and staff interview the facility failed to ensure authorization from a resident or a sponsor with a power of attorney for management of personal funds was attested to by a witness not connected to the facility. This affected four (Residents #7, #18, #50, #51) of five residents whose personal fund accounts were reviewed. The facility census was 49.

Findings include:

1. Review of the authorization to manage funds for Resident #7 dated 01/08/24 revealed no non facility affiliated witness signature was obtained as required.

2. Review of the authorization to manage funds for Resident #18 dated 06/04/24 revealed no non facility affiliated witness signature was obtained as required.

3. Review of the authorization to manage funds for Resident #50 (undated) revealed no non facility affiliated witness signature was obtained as required.

4. Review of the authorization to manage funds for Resident #51 dated 04/03/24 revealed no non facility affiliated witness signature was obtained as required.

Interview on 11/19/24 at 3:51 P.M. with Business Office Manager #418 verified the lack of a non facility affiliated witness signature for Residents #7, #18, #50 and #51.

Based on record review and interview the facility failed to ensure fire drills were conducted as required. This had the potential to affect all 49 residents.

Findings include:

Review of the fire drill documentation dated 11/24/23 through 10/24/24 revealed no third shift fire drill was completed in the second quarter (April through June) and no second shift fire drill was completed in the fourth quarter (October through December). Further review of the fire drills revealed residents were not evacuated to safe areas in at least two fire drills on the second and third shifts.

Interview on 11/19/24 at 11:00 A.M. with Director of Maintenance (DOM) #416 verified the above findings.

Based on record review, policy review and interview, the facility failed to ensure the Grievance Committee was comprised of no more than one staff member to every two residents, sponsors or outside representatives. This has this potential to affect all 49 residents.

Findings include:

Review of the facility's Grievance Committee Member Roster revealed members included Resident #20, Resident #36, one family member, Assistant Activity Director #408, Assisted Living (AL) Director, Administrator, and Social Worker #417.

Interview on 11/19/24 at 2:25 P.M. with the AL Director verified the above finding.

Review of the facility's undated policy titled Grievance/Complaints, Recording and Investigation revealed the policy did not indicate the required ratio of members.

What the surveyor found

Based on observation, interview, and facility policy review, the facility failed to store food in a manner to prevent contamination. This had the potential to affect all 50 residents residing in the facility. The facility census was 50.

Findings include:

On 07/16/24 at 8:42 A.M. a tour of the kitchen was conducted with Dietary Manager (DM) #490. In the dry storage area, there was an opened, four- and one-half pound bag of chocolate frosting mix that was three quarters full. The chocolate frosting was not dated as to when it was opened. There was an opened five-pound bag of corn bread mix that was one quarter full. The corn bread mix was not dated as to when it was opened. There was an opened five-pound bag of breadcrumbs that was one quarter full. The breadcrumbs were spilling onto the floor and other packages. The breadcrumbs were not dated as to when it was opened. In the refrigerator, there was an opened five-pound package of sliced American cheese that was three quarter full. The American cheese was not wrapped or dated as to when it was opened. DM #490 verified the findings at the time of the tour.

An interview with DM #490 at the time of the tour revealed foods should be covered with plastic wrap and dated when they are opened.

A review of the policy titled; Food Receiving and Storage dated October 2017 revealed all foods in the refrigerator or freezer will be covered, labeled, and dated. The policy also stated that other opened containers must be dated and sealed or covered during storage.

This violation represents non-compliance investigated under Master Complaint Number OH00154639 and Complaint Number OH00154616.
